A Living Trust allows you to legally decide two important issues regarding your wealth: how you want your assets and property managed while you are alive, and how you want your assets and property distributed after your death.
A Living Trust can provide for the distribution of property upon your death, just like a Will. But a Living Trust is more effective in many ways: a Will only takes effect upon death, while a Revocable Living Trust provides the same ability to determine asset distribution upon death AND provides a tool for protecting and managing property and assets during your lifetime!
A Living Trust empowers a designated Trustee to manage the trust's assets and property for the benefit of you and your family. The Trustee can be anyone you choose -- including yourself! The asset management in a Living Trust covers any number of financial or property-based transactions: making one-time or recurring cash payments to a beneficiary; transferring assets upon a designated date; making financial moves under a specific set of circumstances; etc.
Further, should you become physically or mentally incapacitated, a Living Trust is critical: it allows you to designate how you want your estate handled without any direct court intervention or supervision. You stay in control of your assets by making decisions and outlining them within the Trust in advance of any incapacitation! The Probate Court is kept out of the management of your estate!
Upon your death, the successor Trustee that you appoint within the Living Trust will act much like the executor of a Will: the Trustee will gather your assets; will pay any valid debts, claims and taxes; and will distribute your property and assets as you have clearly directed. More importantly, the structure of a Living Trust means the assets are owned by the Trust and are not part of the deceased person's estate -- so there is usually no need for a Probate Court's approval before the transfer. As such, the often time-consuming and costly probate process can be avoided!

- Revocable Trust for Non-Married Persons without Children: For use by a single person who wants to provide income to him during his life, and then transfer property after death to the persons that are named as designated beneficiaries. This Trust type is useful for those people who do not have children, or who do not want to transfer property to their children, or who merely want additional flexibility in the transfer of property after their death so as to avoid probate.
- Revocable A/B Trust: For use by married couples with estates that are valued over $5,000,000. The A/B Trust structure allows the maker to take advantage of or maximize certain marital estate tax credits, the amount of which is $5,000,000 for 2012 (although temporary portability may make this amount higher in certain situations). SYSTEM REQUIREMENTS & SOFTWARE FILE SPECIFICATIONS:
Standard Legal Software works on virtually all Windows, Apple / Mac, and Linux-based systems. Links to a downloadable file are presented immediately upon the completion of your transaction. The initial download is provided as a compressed .zip file which much be expanded to access a series of folders containing all of the legal forms, overview files and instruction files. To expand the initial download, most computers come with a decompression utility like WinZip pre-installed; if your computer does not have a .zip utility, we recommend StuffIt Expander (it's FREE!).
The Living Trust title contains an exceptionally large number of forms, given that there are multiple Trust structures and forms that are specific to personal situations under each structure. The initial Living Trust download presents only an overview of the Living Trust process and detailed instructions as to how to log on to our online forms server to download the forms specific to your personal situation. As such, an active web connection is required after the initial software download to access all of the necessary forms. (Read the START-HERE.txt file included in the initial download for specific instructions.) The online forms server allows for the most up-to-date legal documents to be available at any time, and prevents the user from downloading forms that will never be used. Once the proper forms are downloaded from our servers, they are to be completed offline; you do not need to be online to complete any of the forms.
Generally, the legal forms contained within each Standard Legal title are provided in three formats: as Microsoft Word files, as standard text files, and as Adobe PDF files.
